1. Information about the Seller
The website aguamasastral.com (the “Website”) is operated by SC AGUA MAS ASTRAL SRL, with its registered office at Bulevardul Regele Mihai I nr. 57, Baia Mare, Maramureș County, postal code 430013, Romania, registered with the Trade Register under no. J24/497/1993, unique registration code RO3626468 (the “Seller”). You can contact us by phone at +40 752 783 105 or by e-mail at aguamas.astral08@gmail.com, Monday to Friday, between 08:00 and 16:00.
2. Acceptance of the terms and conditions
By using the Website and placing an order, you accept these terms and conditions in full. The Seller reserves the right to amend them at any time; each order is governed by the version in force on the date it was placed.
3. Products and prices
Product prices are expressed in Romanian lei (RON) and include VAT. Prices do not include shipping. The shipping cost is calculated according to the rates published in the Shipping Policy and on the Shipping Rates page and is communicated to you during the telephone confirmation of the order. Images are for illustration purposes only; colours may differ slightly from the actual products depending on your screen settings.
4. Mosaic – telephone orders only
Products in the “Cladding materials/Mosaic” category cannot be purchased online. The price shown for these products is per square metre (m²). Orders are placed by phone only, at +40 752 783 105, when the quantity, availability, delivery time and final price are agreed. The order confirmation is sent by e-mail. A telephone order is a distance contract and is subject to the right of withdrawal set out in section 8, with the exceptions provided by law.
5. Placing an order and conclusion of the contract
No payment is made when you place an order on the Website. After placing the order, you will receive an automatic e-mail confirming that it has been registered. Then, within 1–2 business days at the latest, a representative of the Seller will call you at the number provided in the order to confirm it and to inform you of product availability, the shipping cost, the total order value, the payment method, the delivery time and any other relevant matters (for example, stock changes or the replacement of an unavailable product). The contract is concluded at the time of the telephone confirmation of the order. If you do not agree with the shipping cost or the other conditions communicated, you may cancel the order at no cost.
If we are unable to reach you after 3 attempts made over 3 business days, the Seller may cancel the order and will inform you by e-mail. The Seller may also refuse or cancel an order if the product is no longer available, the data provided is incomplete or the price was displayed incorrectly. In all these cases, any amount paid will be refunded within 14 days at the latest. Any change to the order (products, quantities, price or delivery time) is made only with your consent.
6. Payment
Payment is made only after the telephone confirmation of the order, using any of the methods described on the Payment Methods page. The tax invoice is issued after the order is confirmed and is delivered to you in printed form, together with the products.
7. Delivery
Delivery terms, times and costs are described in the Shipping Policy. The risk of loss of or damage to the products passes to you when you take possession of them.
8. Right of withdrawal
You have the right to withdraw from the contract within 14 calendar days of receiving the products, without giving any reason. The procedure, exceptions and refund method are set out in the Refund Policy, and the model form is available on the Withdrawal Form page.
9. Warranty
All products benefit from the 2-year legal guarantee of conformity, in accordance with Government Emergency Ordinance (OUG) no. 140/2021. Certain products additionally benefit from a commercial warranty provided by the manufacturer, the duration of which varies from product to product and can be obtained by phone or e-mail. 10. Construction, maintenance and waterproofing services
The services presented on the Website cannot be ordered online. They are provided on the basis of a personalised quotation and a separate contract, which sets out the price, execution times and the warranty for the works. These terms apply to services only insofar as the separate contract does not provide otherwise.
11. Limitation of liability
The Seller is not liable for damage caused by installing or using the products contrary to the manufacturer's instructions. Nothing in these terms limits the rights you have as a consumer under the law.
12. Intellectual property
The content of the Website (texts, images, logo and graphic elements) belongs to the Seller or its partners and may not be reproduced without their prior written consent.
13. Personal data protection
Your personal data is processed in accordance with the Privacy Policy and the Cookie Policy.
14. Complaints and dispute resolution
Any complaint may be sent to aguamas.astral08@gmail.com or made by phone at +40 752 783 105; we will reply within 15 calendar days at the latest. If no amicable solution is reached, you may contact the Romanian National Authority for Consumer Protection (ANPC), including through the alternative dispute resolution procedure (ADR / SAL): anpc.ro. Disputes that cannot be resolved amicably fall under the jurisdiction of the Romanian courts. This contract is governed by Romanian law.
